A draft law on gender reassignment was submitted to the parliamentary committee for petitions. Although the members of parliament considered that this was not a matter that should be dealt with by this committee, the petition became a pretext to ask the government about the actions taken in this matter. It was pointed out that the petition concerns a delicate and important problem that should finally be resolved.

  • The Petitions Committee has taken up a highly emotional issue – the draft law on gender reassignment.
  • - Experts indicate that this is too serious a problem to be finalized by the Petitions Committee, which should deal with point changes to the law. Meanwhile, we are dealing with a matter of completely different importance - admitted MP Urszula Augustyn, referring to the petition on this matter
  • According to MP Rafał Bochenek, the issue of gender reassignment was hushed up during the presidential campaign and it should be expected that it will return after the election of the president

The petition for the adoption of the Gender Establishment Act was presented by MP Urszula Augustyn (Civic Coalition). She informed that the petition was accompanied by a draft of the Gender Establishment Act.

- The bill basically repeats the wording of the bill from 10 September 2015, i.e. 10 years ago, which was not passed because it was vetoed by the president and due to the end of the parliamentary term, it could not be processed further - she explained.

It was the first bill vetoed by Andrzej Duda shortly after he took office as president.

The MP said that experts agreed that the petition concerned a delicate and important issue that should finally be resolved.

- Experts also point out that this is too serious a problem to be finalized by the Petitions Committee, which should deal with point changes to the law. However, here we are dealing with a matter of completely different importance - she pointed out.

In connection with this, she proposed that before the Petitions Committee makes a decision, a desideratum be sent to the Prime Minister asking what the current status of work on the gender reassignment act is. - What are the Minister of Justice and the Minister for Equality doing in this regard - she specified and added that the matter could then be revisited.

In her opinion, it would be better if a matter of such great importance was initiated by a citizens' project or, for example, a bill submitted by 15 MPs, and not a project originating from the Petitions Committee, which does not really have the instruments to prepare such a solution.

The proposal to familiarize oneself with the work of the ministries on the issue of gender reassignment was supported in the discussion by MP Marcin Józefaciuk (Civic Coalition) who emphasized that various groups have been waiting for the act for a very long time.

Rafał Bochenek (PiS), chairman of the committee, agreed with his predecessors that this is not a body that should initiate such far-reaching changes. - Changes interfering with the political order of our country and the social order in general, and taking into account the constitution - resulting in repercussions with a large social impact - he assessed.

- It is known that the government has certain intentions in this matter and we would like to know what the work in this area looks like - continued Chairman Bochenek, who supported the motion to file the desideratum. He added that the issue of gender reassignment was hushed up during the presidential campaign and it should be expected that after the election of the president, it will return to the public docket.

Earlier this year, the Minister for Equality, Katarzyna Kotula, said that she planned to prepare a law on gender reassignment. - This is the next plan after the law on civil partnerships - she informed.
