2 thousand fine for selling energy drinks. New regulations in the Sejm on Tuesday

On June 24, the Health Committee will hold its first reading of the government's draft amendment to the Public Health Act. The proposed changes include a fine of up to PLN 2,000 for selling energy drinks to people under 18.
According to the schedule of parliamentary sessions, the first reading of the government's draft amendment to the Public Health Act will take place on Tuesday, June 24, in the Health Committee. The draft will be justified by the Minister of Health.
The draft in question includes, among others, the provision in Chapter 3c. Sale and labeling of beverages with added caffeine or taurine:
Art. 12p. 1. It is prohibited to sell beverages with added caffeine or taurine:
1) persons under 18 years of age;
2) on the premises of the education system units referred to in Art. 2 of the Act of 14 December 2016 – Education Law (Journal of Laws of 2024, items 737, 854, 1562, 1635 and 1933);
3) in vending machines.
2. In case of doubt as to the age of the buyer, the seller may request the presentation of a document confirming the buyer's age.
Art. 12r. The manufacturer or importer of a beverage with added caffeine or taurine is obliged to mark the unit packaging of the product with visible, legible, indelible and permanent information stating "Energy drink" or "Energy drink".
Chapter 4b. Criminal provisions include, among others:
Art. 18d. 1. Whoever, contrary to the provisions of Art. 12p section 1, sells beverages with added caffeine or taurine, shall be subject to a fine of up to PLN 2,000.
The above amendment to the Act is to enter into force on January 1, 2026.
