The Vienna District Court has just delivered its decision in the lawsuit between the Grataloup family and the Bayer/Monsanto company.

The family of Théo Grataloup, born in 2007 with very serious malformations, attributed these disorders to the use of a weedkiller containing glyphosate during the first weeks of the mother's pregnancy. In its judgment, the court declared inadmissible "the family's claims based on tort liability against the company." Their claim for compensation was also rejected.

In a statement, the Grataloup lawyers stated: "This is obviously a great disappointment for the Grataloup family and for us. We were not unaware of the legal obstacles in this case, particularly due to the age of the facts and the evidentiary difficulties that Monsanto was able to exploit, but we believe that the Court had all the elements to render a decision, based on law, recognizing Monsanto's fault. The Court also recognizes that Monsanto was indeed the supplier of the product, which it has constantly contested throughout the proceedings. This case deserves to be submitted to the Court of Appeal."
