A procedure for monitoring compulsory medical measures against pedophiles has been developed

According to the draft, the supervised person must be registered with the criminal executive inspectorate at the place of residence or the place of application of coercive measures. Within three working days from the moment of registration, he/she is sent a notice of the need to appear with identity documents to receive information about the rights, obligations and liability for evading prescribed medical measures.
In turn, if the order is accepted, the medical organization will inform the inspection about the beginning of the application of coercive measures against the patient, about his failure to arrive at the institution three days after receiving the thematic message, about cases of failure to attend the clinic, and so on.
In addition, the draft order stipulates that the inspector is obliged to monitor the arrival of the supervised person to the medical organization on a daily basis, to visit the clinic at least once a month to check the implementation of the prescribed measures, and to include certificates of the results of supervision in the personal file of the accused. In situations where the supervised person refuses to visit the medical organization and implement the prescribed measures, the inspector must conduct a preventive conversation with him. In the future, information about evasion can be brought to the court, which will decide to terminate or change the preventive measure.
The basis for removing a supervised person from the register, according to the draft order, may be a copy of the decision to terminate compulsory medical measures or impose a sentence in the form of imprisonment, the registration of the person at a new place of residence, or a document on his death.
The explanatory note to the draft order states that it has been prepared in order to implement the law signed by Russian President Vladimir Putin in December 2024, amending Article 16 of the Criminal Executive Code of the Russian Federation and Article 13 of Federal Law No. 323-FZ "On the Protection of the Health of Citizens in the Russian Federation". This regulation comes into force 180 days after its publication, which is related to the start date of the draft order.
Among other things, the law allowed the penal inspectorates of the Federal Penitentiary Service (FSIN), which monitor pedophiles after their release, to obtain all medical information about them. Previously, the FSIN's powers in requesting information about compulsory medical measures without the person's consent were limited.
The law specifies that control over the implementation of medical measures in relation to convicted persons will be assigned to the federal executive body in the sphere of execution of criminal penalties and to health authorities.
The thematic bill was submitted to the State Duma in July 2024. The explanatory note to it noted that in 2023, 55 people convicted of committing crimes against the sexual inviolability of minors and suffering from pedophilia were registered with the criminal executive inspectorate, of which 27 were assigned compulsory medical measures.
