PLN 5,280 per month. New child support table revealed

• The table specifies model amounts of child support depending on income, child's age and number of children

The Ministry of Justice has published the so-called Alimony Table, which is intended to serve courts as an auxiliary tool , not as a source of law. Its goal is to increase predictability and objectivity in alimony decisions, shorten the duration of proceedings, and encourage settlements and agreements.

As "Rzeczpospolita" points out, the table, although provided to the presidents of all appellate courts, does not limit the statutory scope of the court's discretion and does not affect previously awarded alimony unless there is a significant change in circumstances . The mere publication of the table does not constitute such a basis.

The model benefit amounts were calculated based on three variables:

• the income of the parent obligated to pay child support,
• the age of the child,
• the number of children for whom the person has a maintenance obligation.

The table refers to a model situation where a child lives with one parent and has regular contact with the other, for example, on weekends. The basis for calculations is the so-called base amount, which is 70% of the child's subsistence minimum for 2024 , as established by the Institute of Labor and Social Affairs.

The amount of child support increases with the income of the obligated person and the age of the child and reflects the estimated monthly costs of meeting basic needs, such as:

• food,
• apartment,
• education,
• culture,
• health,
• hygiene,
• transport,
• communication,
• other reasonable expenses.

The values in the table are calculated by five age groups of children:

• 0-7 years,
• 8-11 years old,
• 12-15 years old,
• 16-18 years old
• over 18 years of age.

Benefit amounts increase by 12.5 percent for each higher age group of the child.

• They increase by 10 percent for every PLN 800 increase in the liable income, up to PLN 8,300,
• Above this amount - by 15% for each additional PLN 800 of income.

In the case of a larger number of children , the benefit per child decreases proportionally, to a maximum of 85 percent for three or more children , however, as emphasized, the needs of children remain unchanged regardless of the number of siblings.

The table was developed in collaboration with the Institute of Justice, following consultations with judges, bailiffs, and family law experts. It was modeled on German and French solutions, among others, but adapted to Polish realities . The maintenance table will be updated annually following the publication of data on the subsistence minimum by the Institute of Law and Social Policy (IPiSS), which is considered the most reliable indicator of a child's justified needs.

The Ministry of Justice - as reported by Super Express - presents sample calculations.

• The established income is PLN 9,000
• 3/5 of the income is PLN 5,400.
• The total value of child support is PLN 6,213 (three children aged 16-18 = PLN 1,936 per child).
• We use the appropriate income range.
• Total benefit amount = PLN 5,280.

The monthly income of the obligated person is determined based on appropriate documentation and certificates.
