Franche-Comté. Failed hemorrhoid surgery: Dr. Clemens, who wants to operate again, will have to wait

Dr. Luc Clemens will wait two more weeks to find out if he is allowed to operate again.
The investigating chamber of the Besançon Court of Appeal was due to rule this Wednesday on the relaxation of the judicial supervision of the Besançon proctologist . The latter has been under investigation since September 2024 for "unintentional injuries" to several dozen of his patients.
The court adjourned the hearing to Wednesday, August 27, to rule out any suspicion of bias. This is because two of the judges on the panel have already handed down rulings in the civil part of this vast case of botched hemorrhoid surgeries.
The judicial review of proctologist Luc Clemens, under investigation since September 2024 , prohibits him from performing surgery.
However, the doctor, who remains presumed innocent, would like to be able to practice urology surgery, not proctology. His first request to do so, dating back to the end of October, had already been rejected. This is why his counsel has referred the matter to the investigating chamber of the Court of Appeal.
The practitioner's defense team has already argued for greater "proportionality" of the constraint. It argues that he is not accused of any act as a urologist. And that, as such, there is nothing to prevent him from operating in this field again. For the victims, this request for further surgery by the Besançon proctologist sends a damaging message.
