"Adapt schedules, suspend arduous tasks during the hottest hours": a decree will soon come into force to protect workers exposed to extreme heat

"Adapt schedules, suspend arduous tasks during the hottest hours": a decree will soon come into force to protect workers exposed to extreme heat

" Heat waves and working in extreme heat can lead to a deterioration in working conditions in most sectors of activity and increase the risk of workplace accidents, including serious or fatal ones ."

The government's observation is not new. Heat waves can be dangerous for employees working outdoors. The effects can include "migraines, cramps, fever, dehydration, and even heat stroke."

So, in order to better protect workers, the government announced a few days ago the publication of a decree that will come into effect on July 1. It will apply to all employees, including agricultural workers.

"Strengthening employers' obligations"

The aim is to "strengthen employers' obligations." In the event of an intense heatwave, employers can "adapt schedules, suspend arduous tasks during the hottest hours, and better adjust rest periods," the Ministry of Labor specifies on its website.

“Filtering or screening devices, ventilation or misting” may also be requested.

Employers must provide suitable equipment : breathable or cooling clothing, headgear, goggles, etc. They also have an obligation to take care of vulnerable workers, particularly pregnant women.

If these measures are not respected , the labor inspectorate can "formally order the employer to establish it" .

Since the summer of 2024, heatwaves have been recognized as a reason for technical unemployment in the construction industry.
